TERMS & CONDITIONS
All sales made by Wakey Cakey Kitchen are subject to the following Terms and Conditions.
Please read through carefully as payment of your deposit will be accepted as your agreement to our Terms and Conditions.
A non-refundable £75 deposit is required to secure the commission of your cake and chosen date with Wakey Cakey Kitchen.
All prices are non-negotiable, and we reserve the right to cancel the quote if the deposit is not paid within 7 days from issue. A new quote will then be issued on request.
Deposits can be made in cash or via bank transfer to Wakey Cakey Kitchen.
Final payment for wedding cakes is required no later than 4 weeks before the collection/delivery. It is your responsibility to remember to send this payment, as a reminder invoice is not issued.
We reserve the right to cancel your order if your final payment is not made on time.
Cheques cannot be used as payment method for the final payment.
Whilst we will always try to accommodate last minute requests, drip cake orders should be placed at least 7 days in advance, wedding cake orders should be booked approximately 6-12 months in advance, via telephone, email or through the business Facebook page. No other forms of booking communication will be accepted, and we cannot be held responsible for any orders, alterations or cancellations communicated via other means.
Delivery is available for drip cakes within a 5 mile radius of Wakey Cakey Kitchen for a charge of £5.00.
Deliveries outside this area will be charged at our standard delivery rate of 0.50p per mile round trip.
Alternatively, drip cakes can be collected from our premises.
Tiered wedding cakes are delivery only, charged at our standard delivery rate of 0.50p per mile round trip.
Wakey Cakey Kitchen will not be held responsible for any damage incurred at the venue once we have set up and left the premises. Photographs are taken from every angle before we leave the premises.
It is your responsibility to ensure that a suitable table is provided on level ground, away from all heat sources, direct sunlight, passing staff or guests, and inquisitive children!
Wakey Cakey Kitchen will make every effort to delivery on time however we cannot be held responsible for circumstances beyond our control e.g. adverse weather or traffic conditions ( also see Force Majeure clause below)
In the unlikely event of late delivery, the maximum compensation will be a refund of the delivery charge.
CANCELLATIONS AND REFUNDS
All cancellations must be notified by Email, telephone or via the business Facebook page.
If cancellation of an order occurs, we reserve the right to retain your non-refundable £75 deposit.
If cancellations take place less than 7 days before the event for celebration cakes, or less than 4 weeks before the event for wedding cakes, we reserve the right to seek 100% of the order value.
We will endeavour to agree an alternative date subject to availability,
If we have started work on your order, any refund issued will be minus all costs incurred.
In the unlikely event you are unhappy with your order, please inform us at time of collection/delivery so that we have the opportunity to rectify any issues in time for your event.
Any concerns arising after acceptance of your order should be made immediately to us via telephone
Please retain the cake for our inspection as consumption is viewed as acceptance that the cake is adequate for purpose.
Repairs made due to damage after delivery/collection are made at our discretion and may be subject to additional charges
Refunds are made at the discretion of Wakey Cakey Kitchen
Cake stands, cutting knives and any other decorative equipment are available for hire subject to a charge of £15 and a security deposit of £25.
All hired items must be returned to us undamaged and complete, in the original packaging supplied, and within 3 days of the event for your deposit refund.
Failure to return your hired items within 3 days of your event, without prior agreement by us, will forfeit your security deposit
From time to time images of our cakes are published in local and industry media.
We reserve the right to use our images of any cake made by Wakey Cakey Kitchen for publication and advertising now or in the future.
Force Majeure event means an event beyond the reasonable control of Wakey Cakey Kitchen including but not limited to strikes or other industrial disputes (whether involving the workforce of Wakey Cakey kitchen or any other party), failure of a utility service or transport network, fire, chemical or radioactive contamination or ionising radiation, earthquakes, lightning, cyclones, hurricanes, floods, droughts, storm or such other extreme weather or environmental conditions, unanticipated geological or ground conditions, epidemic, famine, plague or other natural calamities and acts of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, default of suppliers or subcontractors.
We shall not be liable to you as a result of any failure to perform our obligations under this Contract as a result of a Force Majeure Event.
If the Force Majeure Event prevents us from providing the goods on the required date, we shall, without limiting our other rights or remedies and without liability to you, have the right to terminate this Contract immediately.
